Terms of Service & Usage Protocol

1. Agreement to Terms

Welcome to Bouquetargt (located at bouquetargt.quest). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Bouquetargt Performance Operations ("Company", "we", "us", or "our") governing your access to and use of our web speed benchmark tools, synthetic ping calculators, JavaScript CPU stress tests, and technical intelligence guides.

By accessing or using any component of Bouquetargt, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must immediately cease accessing the platform.

2. Permitted Use & Acceptable Usage Policy (AUP)

Bouquetargt is designed to assist web developers, DevOps engineers, site reliability engineers (SREs), and webmasters in auditing network latency, Time To First Byte (TTFB), Core Web Vitals, and client-side JavaScript execution efficiency.

A. Authorized Activities

You are granted a non-exclusive, non-transferable, revocable license to:

• Run manual speed audits against web domains or API endpoints that you own, operate, or have explicit permission to test.
• Utilize the Core Web Vitals Calculator, Payload Compression Estimator, and CPU Benchmarks for diagnostic analysis.
• Export synthetic audit report outputs for internal performance documentation and optimization planning.

B. Prohibited Activities & Security Restrictions

Specifically, you shall not:

• Use Bouquetargt as an amplification vector for Distributed Denial of Service (DDoS) or HTTP flood attacks against external web servers.
• Script, bot, or automate rapid diagnostic loops designed to exhaust server bandwidth or bypass operational rate limits.
• Reverse engineer, decompile, or attempt to extract source code from proprietary benchmark scripts beyond standard browser developer tools inspection.
• Attempt to compromise our infrastructure, probe for edge node vulnerabilities, or upload malicious code payloads into our diagnostic text inputs.

3. Intellectual Property Rights

All content, source code, interactive widgets, SVG vector graphics, stylesheet designs, typography, brand marks, and technical guides published on bouquetargt.quest are the exclusive property of Bouquetargt or its licensors and are protected under international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any platform materials without prior express written consent from Bouquetargt.

4. Rate Limiting & Automated Traffic Policy

To preserve low-latency execution for all global users, Bouquetargt implements automated rate-limiting algorithms across all edge endpoints.

• Interactive Speed Test Quota: Standard web sessions are subject to burst limits of up to 30 manual audits per hour.
• Automated Scraping Prohibition: Scraping, automated indexing, or headless browser automation targeting our diagnostic engines without authorization is strictly prohibited.

We reserve the right to temporarily or permanently block IP addresses that violate traffic thresholds or demonstrate abusive request patterns.

5. Disclaimer of Warranties

BOUQUETARGT, INCLUDING ALL BENCHMARK TOOLS, SYNTHETIC SPEED METRICS, CORE WEB VITALS ESTIMATORS, AND TECHNICAL GUIDES, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SYNTHETIC SPEED AUDITS WILL REFLECT REAL-USER EXPERIENCES ACROSS ALL ISP NETWORKS, THAT PLATFORM OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT SPEED SCORES ARE BINDING ACCORDING TO THIRD-PARTY SEARCH ENGINE ALGORITHMS.

6. Limitation of Liability

IN NO EVENT SHALL BOUQUETARGT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SPEED PLATFORM.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE MAXIMUM AMOUNT OF ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).

7. Indemnification

You agree to defend, indemnify, and hold harmless Bouquetargt, its subsidiaries, affiliates, and respective directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in any way connected with your breach of these Terms or misuse of our speed diagnostic tools against third-party domains.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of or related to these Terms or Bouquetargt shall be instituted exclusively in the federal or state courts located in Travis County, Austin, Texas, and you irrevocably submit to the personal jurisdiction of such courts.

9. Severability & Modifications

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. We reserve the right to modify these Terms at any time. Updated versions will be posted with a revised "Effective Date". Your continued use of Bouquetargt following revisions indicates acceptance of the amended Terms.
